William was Preceptor of the public Grammar School in Roxbury in 1752, and studied law under J. Gridley. In 1755 he commenced practice in Pownalboro, residing with his brother Charles, and continued his practice there until elevated to the bench. Of all the Judges and Officers of the Courts in the three counties and of the County Officers he was the solitary lawyer, he stood alone as an educated lawyer in this spacious territory and thefirst who settled in Maine. He was one of the 6 lawyers in Maine who were raised to the degree of Barrister. He was for a time Attorney General of Mass.; in 1768, was appointed the first Judge of Probate in Lincoln County and in 1772 made Judge of the Superior Court. At the reorganization of the Superior Court, Massachusetts, 1777, he was appointed Chief Justice of the Court, the first who held the office under the free Government of the Commonwealth and labored with great success in establishing the judicial system on a firm basis. He was Vice-President of the Mass. Convention which ratified the U.S. Constitution in 1788. He was the first Chief Justice of the State under this Constitution, and at theorganization of the U.S. Government in 1789 he was selected by Washington as an Associate Justice of the U.S. Supreme Court, in which office he eminently shone. While Associate Judge, he was accompanied in his circuit by Mrs Cushing; hedrove a phaeton and a pair of horses and was followed by his negro man "Prince" on horseback. During the mission of Chief Justice John Jay, Envoy Extraordinary to the Court of Great Britain, negotiating the famous treaty with the Country, Judge Cushing presided, and as Senior Justice administered the oath of office to Washington at the beginning of his second term as President, 4 March,1793.In 1794 he was a candidate for Governor of Mass., a rival of Samuel Adams. John Adams said of him: "I Shall be happier if Cushing succeeds, and the State will be more prudently conducted." In 1796, after Judge Jay's resignation, he was nominated by Washington to the Chief Justice office, and this offer was unanimously confirmed by the Senate, 27 January, 1796, and on the evening of the same day, was invited to a large dinner party the the President's. As he entered theroom, Washington from the head of the table turned to him and said with great impressiveness; "The Chief Justice of the United States will please take his seat on my right."; but notwithstanding this extraordinary expression of confidence, he declined the office on account of infirm health, but continued on the bench until 1810, when he had prepared an instrument of resignation, but was called to resign life. He was a man of tall and dignified presence, and as he movedalong the streets with his cocked hat, bush wig and small clothes, he made an imposing appearance which attracted general attention. He was the last Chief Justice who wore the large wig of the English Judges. As a Judge he was eminentlyqualified by his learning and not less by his unshaken integrity and deliberate temper. In private life he was all that was amiable, always ready to instructthe useful discourse and to make his friends happy with his cheerfulness. He was a founder and member of the American Academy of Arts and Sciences. A massivegranite boulder marks the spot of his burial on Belle House Neck in Scituate.

His father was chief justice of the superior court of Massachusetts before whom the British soldiers were tried for the Boston Massacre, March 5, 1770. Theson was graduated at Harvard in 1751, studied and practised law with Samuel Gridley, was elected attorney general of Massachusetts, and in 1768 became judge of probate of Lincoln county, Maine. In 1772 he was made judge of the superior court of Massachusetts and its chief justice in 1777, becoming the first chief justice of the state under the constitution in 1780. President Washington appointed him an associate justice of the U.S. supreme court, Sept. 27, 1789, and nominated him as chief justice in 1798, which honor he declined. He was vice president of the state convention of 1788 that ratified the Federal constitution. He helped to found the American academy of arts and sciences, and was a fellow, 1780-1810. Yale gave him the honorary degree of A.M. in 1753, and Harvard that of LL.D. in 1785. He died in Scituate, Mass., Sept. 13, 1870.

Mr. Cushing resided with his brother Charles, who was the first sheriff of Lincoln, and for many years after the revolution, the clerk of the courts in Suffolk. His house stood near the old court-house in Dresden. At the time Mr. Cushing commenced practice there, there was no house on Kennebec river from about two miles above Dresden court-house to the settlements in Canada, except the block-houses at Forts Western and Halifax. The whole country, as a witness once said of it in court, was an "eminent wilderness." William Cushing was appointed the first judge of probate in Lincoln county; he was made chief justice of the Supreme Court of Massachusetts in 1777, and was the first who held the office under the free government of the Commonwealth. He was transferred to the bench of the Supreme Court of the United States in 1789, and died in 1810. He was the last chief justice who wore the large wig of the English judges, which gave him, upon the bench,an air of superior dignity and gravity. Modern customs have put both the wig and gown out of countenance. The two Cushings and also their brother Rowland, settled in Wiscasset, were sons of Judge John Cushing and were born in Scituate, Massachusetts. William in 1733, Charles in 1734, Roland in 1750, all graduates of Harvard College.

He had eight children--three by his first and five by his second wife. He was Deacon of the church at Plymton (at which his brother Isaac was Pastor) about nine years. In 1723 he was the Representative in the General Court from Plympton, and he the office of Ensign in the military company in that town,--in those days, and office of considerable distinction. The Plympton Church Records say, "At a church meeting in Plympton, December ye 26. 1718, Ensign Elcanah Cushman" (and two others) "were chosen Deacons."

"Memorandum, that on Sabbath daye some time in March in ye year 1718/9 Samuel Sturtevant, Elcanah Cushman and Daniel Bosworth were ordained Deacons by the imposition of hands."

His house stood on the highway leading eastward from Plympton Green to Kingston, and was the first dwelling house northward of the bridge over Colchester brook on said road.

His Will was dated 14 Oct. 1725--two years before his death--and was recorded in Book 5, page 330, of the Plymouth Records.

He was buried at Plympton, and the following inscription on his Grave Stone:

SEPT. Ye 4th
1727 IN
Ye 77th YEAR
OF HIS AGE.

He was probably a member of the Plympton church near thirty
years, as his name stands first in the list of those who joined
after the church was first formed. He was, undoubtedly, "a
pious, godly man," devoted to the prosperity of the church, for
no other could hold the important office of Deacon in those
days.
