Elcid Barrett received a letter-of-marque at Sherbrooke for the sloop Antelope, a scummy vessel with a list to port and its sails in rags. He recruited a crew of 20 fishermen and sailed on 4 Jun 1778 for Jamaica. The vessel required constant pumping by all hands, and took 91 days to reach Montego Bay. After 5 days for repairs, the Antelope put to sea and fell in with a Yankee merchant ship, which it chased for 2 days. Finally, at 2 cables away, the Antelope fired its cracked 4 pounders, but the Yankee fired a single return shot that stove in the Antelope and smashed Barrett like a bowl of eggs. A single maimed crew member finally made his way back to Halifax, 6 years later. 5

The 20th Century Biographical Dictionary of Notable Americans, Vol. 3, p.366
Captain William and Mary Dyer, who came from England to Boston, Mass., and joined the First church there in December, 1635. Captain Dyer was disfranchised for "seditious writing" Nov. 15 , 1637, removed to Rhode Island, and was one of the signers of the compact of government for that province, March 7, 1638. He was secretary the same year, general recorder, 1648; attorney-general, 1650-53; member of the general court, 1661-62, 1664-66; general solicitor, 1665- 66, and 1668, and secretary to the council, 1669. He was commissioned commander-in-chief upon the sea in 1653, and headed an expedition fitted out in Rhode Island against the Dutch. His wife, Mary Dyer, was the only woman to suffer capital punishment in all the oppression of the Friends the world over. She accompanied her husband on his mission to England with Roger Williams and Dr. John Clarke to obtain the revocation of Governor Coddington's power in Rhode Island and while there became a convert to Quakerism and a preacher in the society. On arriving in Boston in 1657 she was imprisoned and on the petition of her husband was permitted to go with him to Rhode Island, but never to return to Massachusetts. She returned, however, and with William Robinson and Marmaduke Stevenson was tried and convicted for "their rebellion , sedition and presumptuous obtruding upon us notwithstanding their being sentenced to banish ment on payne of death, as underminers of the government." Robinson and Stevenson were executed, but through the petition of her son, Mayor William Dyer, she was reprieved on the same conditions as before, but in May, 1660, again appeared on the public streets of Boston, and was brought before the court, May 31, and condemned to death. She was executed June 1, 1660.

The meeting was called to order at 7:00 p.m. by Chairman Dale Donovan. Selectmen present included Michael May, Helen Miranda Wilson and Jerry Houk. Selectman Ira Wood was absent. Town Administrator Tim Smith also attended.

Consider suspension of the commercial shellfish permits of Karl Barrio and William Young, Jr., for violation of Town of Wellfleet Shellfish Regulation 8.1.4 \endash the Shellfish Constable read the incident reports relative to this violation from 5/10/05 for possession of over 5% seed; reviewed M.G.L. Chapter 130, Sections 9 and 69 and Town regulations 8.1.2 and 8.1.4; discussed similar incidents which occurred on 7/29/04 at which time neither Mr. Young nor Mr. Barrio were cited; and noted that he has received complaints of fishermen taking seed from the wild and placing it on grants. Mr. Young indicated that the oysters in question were not his final catch as he was in the process of transferring them to other public areas. The Shellfish Constable indicated that he had explained the law relative to "harvested" shellfish to all draggers. He noted that Mr. Barrio and Mr. Young had each indicated that they did not wish to accept the immediate three day suspension of their commercial shellfish permits. May moved and Donovan seconded a motion to suspend the commercial shellfish permit of William Young, Jr. for three days per the recommendation of the Shellfish Constable. Houk noted the recent loss of income for shellfishermen due to closures for red tide and an oil spill and suggested issuing a warning. On the motion the Board voted 3-1, with Houk voting against. Karl Barrio indicated that he had not understood the procedure from the Shellfish Constable and that he was willing to accept the punishment. On a motion by May, seconded by Donovan, the Board voted 3-1, with Houk voting against, to suspend the commercial shellfish permit of Karl Barrio for three days.

· William Young, Jr. asked when the three day suspension of his commercial shellfish permit would begin. Wilson moved and Donovan seconded a motion to delegate the Shellfish Constable to decide on which day the three days of the suspension starts. Houk disagreed with the motion indicating that he feels the days of the suspension should be determined by the Board of Selectmen. Wilson withdrew her motion. On a motion by Wilson, seconded by Houk, that the commercial shellfish permit suspension of William Young, Jr. begin July 27 at midnight and July 28 to midnight July 29 the Board voted 2-2, with May and Donovan voting against. On a motion by Donovan, seconded by May, to instruct the Shellfish Constable to notify Mr. Young and Mr. Barrio of the days of their suspensions the Board voted 2-2, with Houk and Wilson voting against. The Town Administrator noted that the violation notice indicates that the Board of Selectmen determines the suspension date. On a motion by Wilson, seconded by Houk, the Board voted unanimously that the three day suspension of William Young, Jr.'s commercial shellfish permit begin at midnight of July 27. On a motion by Wilson, seconded by Houk, the Board voted unanimously that the three day suspension of Karl Barrio's commercial shellfish permit begin at midnight of July 29.

Shellfisherman loses license, will get public hearing June 13

Shellfisherman Karl Barrio will have a chance to refute charges made by Shellfish Constable Andy Koch, that Barrio was dragging over the "no drag line" on March 24, and that he was caught with undersize oyster seed on March 24 and May 10. But for now his license is gone.

Selectmen Tuesday suspended the license until a public hearing can be held on the charges when the board meets again on June 13.

By then, Barrio expects his attorney will be able to attend the hearing and refute the charges.

He complained that he had no formal notification that his license was going to be suspended until Saturday, when his wife picked up the mail. His lawyer could not attend the hearing this week.

Selectman Mike May, who has a shellfish license, said, "This is a very, very serious thing," and suggested that the board continue the hearing until June 13, but suspend Barrio's license immediately "so that he does not shellfish until then."

The board agreed.

"I don't like doing this, taking away someone's livelihood," Koch told the selectmen. But he noted Barrio's license was suspended for thee days last year, and he has given him several verbal warnings this year, until he decided to cite him and write out tickets.

Koch said he spent a lot of time planting oyster seeds last two years, but has noticed the seeds have been moving southward with the small oysters attached. And when he pulled up to Barrio's dragger on May 10, he saw "a whole mound of the town's culch, little juvenile oysters, everywhere. I was quite upset and told him to kick the stuff overboard, which he did. It is not fair to [other] people in this harbor that Karl gets rich on their dime," Koch said. "I'm sick of it, the fishermen are sick of it, and that's why I decided to go for revocation of his permit."

Barbara Austin, chairwoman of the shellfish advisory board, said she's fished and been friendly with Barrio for 30 years. "But this is a really tough thing," she said. "It has nothing to do with friendship. It's very frustrating when you are on the advisory board and you spend all kinds of time writing rules, and people come to the meeting to complain about things that are happening. We just want to see the rules followed fairly, across the board, to everybody."

She added that Koch and his assistant should be out planting oysters and testing for water quality, and checking the grants, but "they never have a chance to do that because they are so busy chasing people around. It's frustrating when the shellfish department has to work so hard following a couple of people to check their catch. If we can just follow the rules, there would be more time for the things that need to be done."

Shellfisherman seeks reinstatement of Wellfleet permits

WELLFLEET \emdash Karl Barrio will attempt to temporarily regain his shellfish grant licenses and commercial shellfish permit today in Barnstable Superior Court.

On March 27, the board of selectmen revoked Barrio's licenses and 2012 permit after discussing his alleged involvement in the possible removal of oysters without permission from someone else's grant in February. A police investigation resulted in no criminal charges being filed, and the issue was transferred to the town for an administrative hearing before the selectmen.

A commercial shellfish permit allows a fisherman to sell seed shellfish, and a grant license allows a fisherman to plant, grow or take shellfish within a specific area. Barrio shared a grant on Indian Neck with a second person who is not involved in the lawsuit, Craig Nickerson, the attorney who represents Barrio, has said.

Barrio is suing the town of Wellfleet, the board of selectmen and the town's shellfish constable, Andrew Koch, saying he was denied due process and that Selectman Berta Bruinooge shouldn't have voted on the revocation because of a conflict of interest. He filed the civil complaint June 25.

In the long run, Barrio wants his licenses and permit restored permanently, wants to be reimbursed for his lost profit and income and his expenses, and wants any other relief the court thinks is appropriate.

Neither he nor Nickerson was available for comment Monday. The town, in a response filed July 5, said Barrio shouldn't regain his licenses or permit temporarily because he had only 60 days to appeal the selectmen's decision but took 85 days. He also should have taken his complaint about Bruinooge to the state Ethics Commission first, the town argues.

The town also claims that Barrio's initial complaint doesn't contain enough evidence to support the motion to temporarily reinstate his licenses and permit.
