Robert Cross O’Brien, 76

Brookfield, Conn. - Robert Cross O'Brien, 76, died Dec. 2, 2006.

He was the beloved husband of Margaret Hurley O’Brien.

Born on Cape Cod, he graduated from Barnstable High School and went on to graduate cum laude from Boston College in 1952. He graduated from Officers Candidate School in Newport, R.I., that same year, and was stationed in Sasebo, Japan, as a lieutenant in the Navy from 1953 to 1955. He then served on board the USS Mississippi from 1955 to 1956.

Upon leaving the Navy, Mr. O’Brien entered Georgetown Law School, and was a member of the board of editors of the Law Review. He graduated in 1958 with J.D. and LLM degrees.

He worked as an attorney at the Securities and Exchange Commission in Washington, D.C., from 1958 to 1961. He then joined the law firm of Whitman, Ransom and Coulson in New York City, and became a partner in 1963. He led the expansion of the firm into Connecticut and was pivotal in several major firm mergers. He headed the corporate department, serving many international clients, including Cerveceria Polar and Avis Corporation, where he served on the board of directors. He practiced in New York City and Greenwich, Conn., for 39 years until he retired in 2000.

Mr. O’Brien is remembered for his intellectual curiosity, integrity, and love of life. He was a gifted singer, gourmet cook, writer, painter, and gardener, and he was a friend and mentor to many. Above all this, he was a natural father who weaved faith, humor, values and optimism into the fabric of his family.

In addition to his wife, survivors include his children, Meghan O’Brien, Christopher Cortis O’Brien, Sean Cross O’Brien, and Caitlin O’Brien; two brothers, Stephen B. O’Brien and Joseph M. O’Brien of Centerville; a sister, Margot O’Brien Carey of Sudbury; an aunt, Mary Cross O’Brien of Centerville; and 23 nieces and nephews.

Cape court officer arraigned in alleged scams

BARNSTABLE - A Barnstable court officer was arraigned today in Barnstable Superior Court on multiple counts stemming from a series of alleged scams.

Paul F. O'Connell, 62, pleaded not guilty to five counts of larceny of more than $250 by false pretense and two counts of larceny of more than $250 by false pretense on someone older than 60.

The charges stem from a series of scams O'Connell allegedly orchestrated over several years on five victims. The schemes allegedly netted O'Connell thousands of dollars, according to police.

Following the arraignment, Judge Christopher Muse allowed a joint motion for the case to be transferred to Plymouth County Superior Court, citing O'Connell's relationship with the Barnstable courts.

He has a pretrial conference on Aug. 7 in Brockton.

O'Connell has been an associate court officer, or "blue shirt," since 2006. When he was indicted last month, he had been on paid leave since February. Whether his employment status has changed since is unknown.

BARNSTABLE \emdash After more than five months away from his job, court officer Paul F. O'Connell was back Thursday in Barnstable Superior Court.

This time, though, he wasn't seated near the front door in his crisp, blue uniform, ready to screen courtgoers. Instead, he stood in the front row of a cramped secondary courtroom in a dark, pinstriped suit, pleading not guilty to charges that he bilked thousands of dollars from unsuspecting victims.

A Barnstable County grand jury indicted O'Connell, 62, an associate court officer in Barnstable, last month on five counts of larceny of more than $250 by false pretense and two counts of larceny of more than $250 by false pretense on someone older than 60 for defrauding at least five victims out of between $50,000 and $100,000. If convicted, he faces up to 45 years in prison.

O'Connell allegedly presented the victims with investment opportunities in business interests he didn't have, according to investigators.

The five victims \emdash four women and two men \emdash either could not be reached or declined to comment. The Times does not disclose the names of victims of alleged crimes.

In court, O'Connell stood up straight, arms crossed, as he denied the allegations against him. w

"Not guilty," he said before returning to the wooden bench.

The case initially was assigned to the Plymouth County district attorney's office to avoid any perception of bias, according to prosecutors. That was taken a step further in court Thursday after Judge Christopher Muse allowed a joint motion from Special Prosecutor Jessica Healy and O'Connell's attorney, William Gens, to move the case to Plymouth Superior Court in Brockton.

After the brief hearing, Gens denied any wrongdoing by his client.

"These cases always have that not-so-fine line about whether it's criminal or not," he said about whether his client had done anything illegal.

O'Connell is due in the Brockton court Aug. 7 for a pretrial hearing, according to court records.

He was hired as an associate court officer, or "blue shirt," in 2006 and was responsible for maintaining perimeter security for the Barnstable court complex. He usually worked the front door of Superior Court and was always ready with "hiya" or "how are ya?" for visitors.

On Wednesday, he was placed on unpaid suspension by the state's Trial Court division, according to a spokeswoman. Before then, he had been on paid administrative leave since February. The salary range for associate court officers is $27,000 to $37,000 per year.

The investigation into the alleged crimes began last year when one victim came forward to police, according to investigators.

At least two victims knew or associated with O'Connell through his position as a trial court officer, but it's unclear exactly how many knew him in that capacity, according to police.

Most of the alleged schemes were similar in their undertaking. O'Connell would offer the victim an investment opportunity in a small business \emdash including a nonexistent cleaning company \emdash in which he was supposedly involved, according to police.

Since O'Connell's indictment, no additional victims have come forward, but police still believe more people might have fallen for O'Connell's alleged schemes, Barnstable police Detective Lt. Sean Balcom said.

Anyone with information about O'Connell's alleged crimes is encouraged to call the Barnstable police detectives unit at 508-771-6237.

Marriage Notes (Philip Sherman)
"Phillip Sherman of the Dedham line, was born February 5th, 1610 in Dedham, England, married Sarah Odding daughter of Mrs. John Porter by a former marriage. In 1634 he came to New England and settled at Roxbury, Mass. In the Anne Hutchinson troubles at Boston he took her side, but as Governor Winthrop prevailed he with others found it convenient to move to Rhode Island. In Providence they met Roger Williams, who advised them to purchase the island of Aguetuct (Aquidneck) now Rhode Island of the indians. The purchase was completed March 24, 1638. On July 1st 1639 they established a regular government with William Coddington, Governor, and Phillip Sherman, clerk. After this he often held office in the Colony in critical periods. After he removed to Rhode Island he left the Congregational Church and united with Society of Friends."
