PROVINCETOWN \emdash Police say an accident took the life of a former Truro selectman early yesterday.
Robert J. Martin, 73, was found in Provincetown Harbor near Fisherman's Pier between 1 and 2 a.m., Provincetown police Chief Jeff Jaran said. Witnesses said they last saw Martin alive about one hour before his body was discovered in the water, the chief said.
Martin's death is under investigation, but "it appears to be an unfortunate accident and alcohol may have played a role," Jaran said.
Out of respect for the family's privacy, Jaran declined to give any further details about the circumstances of Martin's death.
Martin served as a Truro selectman for about 12 years, through the 1990s, according to his wife of 49 years, Margo. "He was a very outgoing person, and he enjoyed doing things for the town," the North Truro resident said.
Martin was born in Provincetown.
He served in the Marines during the Korean War. Upon returning to Provincetown, he met his wife and they married in 1959. They had four children, including a daughter, Robyn Lynn, who died at 2 months of age, Robert II, Wayne, and Ann Encarnation. They have three grandchildren.
"Bobby" Martin ran Souza/Martin real estate in Truro for many years, but he gave up much of his real estate business when he became a selectman, she said.
"Bobby was a very caring person," said his longtime friend, Bill Burrell.
"He was always for looking out for the underdog," he added. "If Bobby was your friend, he was your friend through thick and thin."
As a politician, Martin battled to make sure the Cape Cod National Seashore was fair to local towns, Burrell said. "He didn't golf, but both he and I fought very hard to keep the Highland Golf Course in the town," he said.
Under an agreement hammered out by Truro officials, the Cape Cod National Seashore leases the Highland Golf Links to the town, rather than to a private concessionaire.
Martin and Burrell took many hunting trips together with their sons to upstate New York. Martin also enjoyed fishing.
Despite his full and happy life, alcohol was a specter, friends and family said.
Martin drank until 1971, Burrell said, adding his friend then stayed sober for 30 years.
"For years, when we went hunting, we'd go to bars and Bobby would always come with us," Burrell said. "And he'd just drink Cokes and when it was his turn to buy a round, he'd buy a round. He never touched a drop."
Martin's commitment to sobriety changed about three years ago, his wife said.
"It's sad the way Bobby died," Burrell said. "He fought the demon of alcohol and he lost. He was a real good man. I hope people will remember him that way and not the way he was in the last two years."
When he started working at a local VFW hall, alcohol "was too handy," Margo Martin said.
Recently, she said, he began cutting the lawn again. And they had enjoyed some peaceful times drinking coffee in her garden.

TRURO-Robert Martin, 73, died unexpectedly Sept. 12 in Provincetown.
Mr. Martin was born in Provincetown, the son of the late Henry and Lillian (Santos) Martin. He was a graduate of Provincetown High School and served in the Marines during the Korean War. While serving in the Marines Mr. Martin was part of Operation Plumbbob at a Nevada test site, in which approximately 18,000 members of the U.S. Air Force, Army, Navy and Marines participated. The military was interested in knowing how the average foot soldier would stand up, physically and psychologically, to the rigors of the tactical nuclear battlefield.
In 1958 while at a beach party he met Margo (Phillips), whom he married the following year. They have been married for 49 years. Mr. Martin had been a Truro resident for about 30 years. When he lived in Provincetown he served on the town finance committee. He was a former real estate broker and a Truro selectman for approximately 12 years. He was also a bail commissioner for about five years.
Mr. Martin served as a public official with the same philosophy with which he lived his life, that of compassion and fairness for everyone he met. Most recently he worked as the secretary and treasurer for the Lewis A. Young VFW Post #1348 in Provincetown. When not helping other people, he enjoyed hunting and fishing.
Besides his wife Margo, he is survived by his daughter, Anne Encarnation, of Hyannis; two sons, Robert J. Martin II and Wayne P. Martin, both of North Truro; three grandchildren; two brothers, Kenneth Martin, of Provincetown, and Ronald "Gus" Martin, of North Truro; and his sister, Lillian, of Rhode Island. He was brother of the late Marjorie Blackwell, Helen Ventura, Charles Landry, Shirley Landry and Henry Martin.
Visiting hours are from 5 to 7 p.m. Wednesday, Sept. 17 at the Gately-McHoul Funeral Home, 94 Harry Kemp Way, Provincetown. A graveside service will take place at 11 a.m. on Thursday, Sept. 18, in the Martin family lot at St. Peter the Apostle cemetery. Report details night of Provincetown drowning

PROVINCETOWN \emdash Police and rescuers took 40 minutes to pull drowning victim Robert J. Martin Sr. from Provincetown Harbor on the night of Sept. 12, 2008, as he floated face down in choppy waters 10 feet offshore near Fisherman's Wharf, a police report states.
Martin's wife, Margo, of Truro has filed a $900,000 negligence claim against the town alleging town employees didn't try to rescue or resuscitate her husband when he might have been saved. She also alleges the town didn't maintain its beachfront, drain pipes, culverts and ditches, creating hazards that contributed to her husband's death. The letter stating Margo Martin's claim was sent to the town Sept. 4, 2009. But the claim only become public this week after the Times requested a copy of the letter from town officials.
The police report on Martin's death states that heavy rains and wind, high tides, choppy seas, poor lighting on the beach, a buildup of seaweed, storm drain construction and blocked vehicle access contributed to the delay in retrieving Martin's body.
The town is refuting Margo Martin's negligence claim through its insurance company, Town Manager Sharon Lynn said Tuesday.
Martin's death was ruled a drowning with no foul play involved, Cape and Islands First Assistant District Attorney Michael Trudeau said yesterday. At the time of Martin's death, Provincetown Police Chief Jeff Jaran said the drowning was likely "an unfortunate accident."
"Officers are trained to do as much as they can while also being responsible for their own well-being," Jaran said of any suggestion that his officers failed to act appropriately. "I wouldn't ask the officers to act unless they feel they can act safely. We don't have a scuba team. We don't have a marine patrol. We're boots on the street and request assistance from the harbor master and the Coast Guard."
Provincetown Public Works Director David Guertin said yesterday he was not aware of Margo Martin's claim that the town's beachfront was unsafe in September 2008. "I don't know anything about it," he said.
Martin, who was 73 at the time of his death, was a longtime Truro selectman and real estate agent, and an avid hunter and fisherman. After maintaining sobriety for three decades, he had struggled with alcohol abuse in the last few years before his death, according to a former business associate and comments Margo Martin made in 2008.
Among the last people to see Martin alive was shuttle bus driver Albert Robinson of Truro, who saw Martin stumble and fall near Fisherman's Wharf at about 8 p.m., the police report states. Robinson told the police he helped Martin to a bench. He said Martin smelled strongly of alcohol and Martin had said he'd had too much to drink and "just needed some air."
Robinson tried to get Martin on the bus, the police report states. Instead, Martin headed toward the beach. Robinson made his scheduled shuttle runs and came back to check on Martin. When Robinson walked to the water's edge at the beach, he saw sneakers bobbing, then jeans and a shirt, and thought it was Martin. He called the police at about 9:39 p.m.
Five Provincetown police officers were the first town employees to arrive at the scene, the police report says. The officers confirmed there was a body in the water and called fire department rescuers, the Coast Guard and state police detectives. A harbor master arrived on the scene as well.
One delay in retrieving Martin's body from the water included a Coast Guard crew needing to return to its station in Provincetown to get a shallower draft boat, the police report says. Two town paramedics eventually used a long pole with a hook to pull Martin from the water, ripping his T-shirt and a belt loop, the police report states. He was declared dead at 10:20 p.m.
"It was very difficult to determine the depth of the water, and there was a lot of seaweed in the water and about five-feet wide along the beach," Provincetown police Sgt. Carrie Lopes wrote in her report. Lopes reported a driving rain, white caps on the water, little illumination from street lights and an inability to put cruiser lights on the drowning victim because a concrete bulkhead and guardrail were in the way.
"These conditions made it dangerous for police or fire personnel to enter the water and try to retrieve the body," Lopes wrote in the police report.
Under state law, Margo Martin's claim against the town could be brought to court, given the town has had six months from the date of the widow's letter to either deny the claim or settle it. But Margo Martin has no more than three years to file a court case, starting from the date of her husband's death.
