NORTH EASTHAM \emdash Manuel S. Leal of North Eastham passed away peacefully on March 29, 2012. He was the husband of the late Louise (Roberts). He is survived by two nieces, Vivian Constanza of Andover and Lorraine Cambra of South Yarmouth; many grandnieces and nephews and great-grandnieces and nephews.

Mr. Leal was born in Provincetown and served in the Army during WWII. He enjoyed traveling a great deal and had been spending his winters in Florida and summers on Cape Cod. He was a member of the Knights of Columbus and the VFW.

Visiting hour will be held at Morris, O'Connor & Blute Funeral Home, 58 Long Pond Drive, South Yarmouth on Tuesday, April 3. from 9:30-10:30 a.m. A funeral Mass will follow at St. Pius X Church in South Yarmouth at 11 am. Burial will be at 2:15 p.m. at the Massachusetts National Cemetery in Bourne.

gives us a still further account of the whaling fishery of the early days."In July, 1674. I was born at South Hampton on Long Island. When I was eighteen years of age (1692) I came to Cape May and that winter had a sore fit of the fever and flux. The next summer I went to Philadelphia with my father Christopher who was lame with a withered hand, which held him till his death. The winter following, I went whaling, and we got eight whales, and five of them we drove to the Hoarskills (near Cape Henlopen), and we went there to cut them up, and stayed a month. The first day of May we came home to Cape May, and my father was very sick, and the third day, 1695, departed this life at the house of Shamgar Hand, Then I went to Long Island, stayed that summer and in the winter went whaling again, and got an old cow and a calf. Marriage Notes (John Hall)
"John Hall, the founder of the Hall family of Yarmouth, was among the early settlers. The exact date of his arrival is not known. He was for a time in Barnstable. Probably he came about 1657. It is claimed that he came from Coventry, England. He was twice married; his first wife being Bethia. and his second Elizabeth. His family consisted of twelve children, nine of them sons, namely: Samuel, John, Joseph, William, Benjamin, Elisha, Nathaniel, Gershom and one other. With this patriarchal family, Mr. Hall cast in his lot with the builders of Yarmouth. He took his farm in the central part of the village of Nobscusset, at the head of the stream which runs westerly and southerly through North Dennis. He was a worthy citizen and a valuable addition to the growing town. He was buried at a good old age, on his own land, in 1696. His gravestone is the oldest in North Dennis. His sons rendered much service to the town: some going on military expeditions against the Indians and others filling important civic stations.

From the Hall family have gone out numerous emigrants to people distant towns. Some went to Oblong, now a part of Putnam county, New York, others to Ashfield, and various places. Rev. David B. Hall, of Duanesburg, has published a genealogical and biographical history of the Halls of New England. The Halls, who are all descended from John, of Yarmouth, number 235 families. Moral and intellectual traits are hereditary and become characteristics of certain families. The Halls have been much swayed by religious emotions, and interested in things of the mind; hence the number of ministers, deacons and teachers among them. In Yarmouth, including North Dennis, we find the following persons filling the deacon's seat: John, Joseph, Joseph, Daniel, Nathan and Barnabas Hall. The family required eight pews in the East Precinct meeting house to accommodate its worshippers. The descendants of the Yarmouth Halls are well represented in the teachers' vocation in this generation. Stanley Hall, now president of a University; Joseph Hall, principal of the Hartford high school, both Ashfield men; Isaac F. Hall, superintendent of Leominster schools, and Luther Hall, superintendent of schools in Dennis, illustrate this hereditary tendency in the descendants of the pious John Hall."

"Because there was a JOHN HALL in Charlestown with wife Bethia some years earlier than the marriage of Elizabeth Learned to a John Hall of Charlestown, the suggestion has been made that one John Hall married successively the sisters Bethia and Elizabeth Hall. This hypothesis has two fatal flaws. First, marriages between a widowed man and his first wife's sister were considered incestuous in seventeenth-century New England, and only one or two instances are known. Second, the JOHN HALL with wife Bethia had moved to Cape Cod before the marriage between John Hall and Elizabeth Learned; these were two different John Halls." GMB

"Some sources state that a Sarah "Leonarde" baptized on 30 September 1604 at Ware, Hertfordshire, was the first daughter of the immigrant, but the date of this baptism precedes the only known marriage of William Learned by two years, and the surname in the Ware baptism is not one of the usual variants of Learned." 6
Marriage Notes (Thomas Ewer)
On June 14, 1635, "Tho[mas] Ewer," tailor, aged 40, "Sara Ewer," aged 28, "Elizabeth Ewer," aged 4, and "Tho[mas] Ewer," aged 1½, were enrolled at London as passengers for New England on the James [Hotten 88]. It is unknown why the two older children, John and Sarah were not included with their parents on the James, but they did eventually arrive in the Massachusetts Bay Colony and remained there for the rest of their lives.

Thomas Ewer would not live long after his arrival in the Massachusetts Bay Colony. He died sometime in 1638 at Charlestown, Massachusetts, the place where he first moved his family after their arrival in New England. "On 4 December 1638, "[blank] Ewar was allowed executrix of her husband, Thom[as] Ewar, deceased" [MBCR 1:248]. His short years in the colony were exciting ones however. On August 3, 1637, Thomas Ewer was accused of speaking treason against the King of England. According to a man by the last name of Brooks, who testified before the Governor, John Winthrop, that Thomas Ewer had, about twelve months prior, said; "that, if the King did send any authority hither against our patent, he would be the first should resist him" The matter was resolved after Governor Winthrop called all of the persons involved and bound them over to the General Court. The poor, hapless Brooks brought his wife with him and her testimony did not agree with his. Likewise, the other three witnesses that Brooks named disagreed with his story about Thomas Ewer. It was finally agreed and written down accordingly that Thomas Ewer had said, "that, if there came any authority out of England contrary to the patent, he would withstand it." This statement was substantially different from the first statement, primarily because the King was not mentioned and because it was determined that Brooks "did bare malice" towards Thomas Ewer, the authorities could rest easy that Thomas was not the rebel he had been reported to be. Less than a year later, on June 5, 1638, Thomas Ewer would be fined 40s "for leaving his pit or well open, in which a child was drowned" [MBCR 1:233]; in the general amnesty of 6 September 1638, this fine was reduced to 10s. "[MBCR 1:245].

It was in November of 1635 that Thomas and his family located at Charlestown; " On 12 November 1635, "Tho[mas] Ewar [was] admitted & granted to plant next to Mr. Palmer's on this side Wenotomie River upon the line by New Towne bounds" in Charlestown "[ChTR 17]. On March 3. 1636/37, "Goodman Tho[mas] Ewar" was granted "one cow's hayground" near Goodman Hutchinson "if he have not Goodman Wm Larnet's in the saltmarsh against the oyster bank in Mistick" [ChTR 26]. On March 6, 1636/37, "Goodman Ewar [was] to have Goodman Larnett's haylot which he left in exchange for some marsh by his house if Mr. Pratt require not the grant" [ChTR 26]. And it was also noted that on the same day; On 6 March 1636/7, "Tho[mas] Ewar" held five acres of land Mysticside [ChTR 27]. In 1637 "Tho[mas] Ewar" held 6¬ cow commons [ChTR 32]. In the 23 April 1638 accounting of Mystic lands, "Tho[mas] Ewer" held parcels of twenty-five, sixty and five acres [ChTR 37].

Thomas Ewer was appointed to to various responsiblities as well; Charlestown highway surveyor, 17 February 1636/7 [ChTR 25]. Committee to stint the common, 17 February 1636/7 [ChTR 25]. Committee to lay out bounds between Charlestown and John Winthrop's farm, 1 May 1637 [ChTR 28]. Constable, 3 February 1637/8 [ChTR 34; MBCR 1:220]; on 20 August 1638, "Willi[am] Brankenborow being chosen constable of Charlestowne, in the room of Thom[as] Ewar, did take his oath to that place" [MBCR 1:230].

It is generally believed that Thomas Ewer died after June 5, 1638 and before August 20, 1638. It was on December 30, 1638 that "Sarah Ewar" held 6¬ cow commons [ChTR 42]. In the 1638 Charlestown Book of Possessions, "Sarah Ewer late wife of Tho[mas] Ewer of Charltowne deceased" held eleven parcels: "dwelling house with a garden plot, situate in the middle row"; "three rood of ground ... in the East Field"; "one acre and half of arable land ... in the High Field"; "two acres of meadow ... in the South Mead"; six and a quarter milch cow commons; "eight acres of arable land ... in the Line Field"; "five acres of meadow ... in Mistick Marshes"; "five acres of woodland ... in Mistick Field"; another "five acres of woodland ... in Mistick Field"; "twenty and five acres of woodland ... in Mistick Field"; and "sixty acres of land ... in Rock Field" [ChBOP 29-30].

In 1639, "Sarah Ewer, widow, sole executrix of Thomas Ewer, deceased, bargained and sold unto Francis Willoughby of Charltowne, one dwelling house, with a garden plot, situate in the middle row, butting south and west upon the market place" [ChBOP 93].

When Gardy James sold land to Rowland Layhorn on 28 March 1649 James recited that the five acre lot had been bought by him from John Power, hosier, "who had it of William Mirable, and he had it of Georg. Michel, who had it of William Learned, which was the first proprietor" [ChBOP 101].

William Learned and Goodith, his wife, were sdmitted to the First Church of Charlestown, 6 Oct1632. (C.E. Banks Winthrop Fleet, Baltimore, 1961 p.79); he was elected freeman, 14 Mar 1634, selectman, 13 Feb 1635/6, and 26 Feb 1638, member of a committee of six: "Mr. Increase Nowell, Mr. Zach.Sims, Mr. Jno.
