You may score first blood for Marcus H. Howes of Barnstable in his dispute with the town over the clam flats he alleges he owns in the harbor, Judge Frederick C. Swift finding him not guilty of spreading nets over them so as to impede navigation. The court held that the state had not proved its case in the action brought by Clam Warden Ernest O. Dottridge, and the claim of Mr. Howes to ownership of the flats did not enter in the case. Continued litigation is expected and Mr. Hows says that the clams covered up belong to him as he planted them, alleging still further that the flats are his, having obtained deeds for them from people whose assets they are being descendants of the original owners.

Barnstable Harbor, which for three centuries has been Cape Cod's largest clam producing area, has been allowed to deteriorate into an unproductive "mud hole," a group of local citizens told Selectmen yesterday during a hearing to discuss the application of Marcus H. Howes for a ?ve-acre clam ?at grant.
