Will proved 20 Jun 1728.
He was 'of Rochester' when he wrote his will 4 Aug 1710, and there is no evidence that he moved to Sandwich before he died. His will was probated in Plymouth County, not Barnstable County.
He apparently lived with his mother in Rochester and had received some land there from her. He did a lot of exchanging of land in Rochester. Many of the deeds were recorded long after they had been dated.
In a deed acknowledgement of 1717/1718, Freeman Ellis was described as a cooper.
His widow and son Joel were co-executors of his will, and his inventory was taken by Stephen Wing, Samuel Wing, and Thomas Doty and dated 7 Aug 1728.

GIDEON3 ELLIS (? Freeman,2 Lt. John1), born 5 Feb. 1700/1, died intestate m Sandwich in 1760.
The first record we find of this Gideon Ellis is the intention of his marriage made in Plymouth, 11 Feb. 1719/20, to ANNA4 CLARKE (Mayflower Descendant, vol. 18, p. 142), born in 1700, died in Sandwich 13 June 1738, eight days after her tenth child was born, daughter of Thomas3 Clarke by his third wife, Elizabeth (Crowe) Clarke. Gideon Ellis married, secondly, in Sandwich, 15 May 1739, JEMIMA WOOD, born 2 July 1712, died testate in Sandwich in 1782, daughter of Elnathan and Patience Wood of Middleborough.
"Gideon Ellis cordwainer, of Plymouth" by deed dated 3 May 1721 purchased for £80. a 55 acre tract of Plymouth housing and land from Hezekiah Bosworth "of Cape Cod" (PLCD, vol. 15, p. 215). Described also as "cordwainer of Plymouth" by deed 11 Feb. 1722/3 he purchased for £110. from Eleazer & Hannah Churchill of the same town 7 more acres there (ibid., vol. 16, p. 144). On 7 March 1724/5 he bought from his brother-in-law, Josiah Clarke, for £9. land described as "at Monument Ponds, ... bounded by Joseph Silvester ... and ... my honoured father's" land (i.e. Thomas Clarke) (ibid., vol. 25, p. 26). On 29 May 1725 he paid £112. to "Joseph Bartlett of Plymouth, seafaring man" for a 30 acre tract near Fresh Pond (ibid., vol. 19, p. 106).
In the settlement of the estate "of Dea. Thomas Clarke of Plymouth, yeoman, deceased," dated 27 April 1727, "Anna Ellis wife of Gideon Ellis hath settled upon her & her heirs and assigns ... one quarter part of ye one halfe of ye farm att Middleborough, and cedar swamp thereto belonging. She hath out of ye residue of ye personal Estate, her portion." This agreement was signed 12 May 1727 by all the heirs, including Gideon Ellis and the mark of Anna Ellis (Plymouth County Probate, vol. 5, p. 235).
On 28 June 1728 "Gideon Ellis of Plymouth ... cordwainer" exchanged with John May of same a tract of Ellis land there described as having belonged at first to Thomas Dotey, for which he received from May a farm where the latter "now dwelleth" at Monument Ponds, "bounded northerly by Elizabeth Bartlett ... southerly by Indian lands, Westerly by John Barnes & Easterly by the Sea" (PLCD, vol. 23, p. 79-80). In the same year he bought 160 acres from John Barnes which he sold 10 Nov. 1730 to John May and John Wetherhead (ibid., vol. 26, p. 13; vol. 27, p. 25). He, with William Ellis and Benjamin Cornish, bought tor £47., by deed 17 Feb. 1728/9, two parcels of land in Plymouth from Ebenezer Thomas of Norwich, New London Co., Conn., both at Ship Pond alias Attanantumuk, 80 acres in all (ibid., vol. 24, p. 13). By deed, 1 March 1728/9, Gideon Ellis and Anna his wife, Josiah Morton & Elizabeth his wife, Nathaniel and Abigail Bartlett and Sarah Clarke, all of Plymouth, sold for £200. to Samuell Wood of Middleborough all the one half lot at Middleborough [(which they had inherited of the father, Dea. Thomas Clarke (ibid., vol. 26, p. 182)].
It seems from the foregoing transactions that Gideon Ellis was comfortably established in Plymouth. However, 18 March 1731/2, he sold for £350. to Samuel, Thomas and Jane Cornish his entire homestead farm, "where I now dwell," at Monument Ponds which he had bought from John May less than four years before (ibid., vol. 27, p. 144). This was in preparation of his impending removal to Sandwich as two deeds prove: (1) "Gideon Ellis, late of Plymouth, now of Sandwich ... yeoman," sold for £19. to John May of Plymouth three lots at Little Meadows, which Ellis had bought from the said May "some time ago," 7 Feb. 1733/4 (ibid., vol. 28, p. 152). (2) "Gideon Ellis of Sandwich husbandman, sold for £9. paid by Nathaniel Bartlett of Plymouth 3 parcells in Plymouth which Ellis had bought from his brother-in-law Josiah Clarke" (ibid., p. 186). Through this sequence of deeds "we are able to be certain that it was this Gideon Ellis who purchased the farm of Benjamin Perry of Sandwich, which became his homestead, as noted by Betsey D. Keene in her History of Bourne (1937), p. 57 (see also THE REGISTER, vol. 115, p. 98, April 1961).
But Gideon Ellis had not quite finished dealing in Plymouth County land: "Gideon Ellis of Sandwich," by deed dated 1749 (acknowledged 4 Dec. 1751, recorded 31 March 1756), bought for £12. from "Josiah Bump of Lebanon ... Conn." a parcel of Cedar Swamp in Wareham which had belonged to the grantor's father, Isaac Bump (PLCD, vol. 43, p. 215). And by an indenture, dated 5 Nov. 1756, "between Gideon Ellis of Sandwich ... yeoman, and Jemima his wife, John Tomson, yeoman & Lydia his wife & Ephraim Wood of Middleborough; whereas the above parties stand possessed of a certain tract of land given them by their honoured father Elnathan Wood, late of Middleborough, deceased, to his five daughters in his last will and testament, about 50 acres, whereof Gideon & Jemima Ellis in behalf of one-fifth John Tomson & Lydia his wife 3/5ths, and Ephraim Wood 1/5th." Division agreed and sworn 5 May 1756; recorded 1 May 1760 (PLCD, vol. 46, p. 90).
Gideon Ellis died intestate in Sandwich before 10 Dec. 1760 when his estate was appraised by Thomas Bourne, Elijah Perry and Samuel Tobey: real estate about £500.; other property £127. 4s. 8d. Sworn 17 Feb. 1761 (Barnstable County Probate, vol. 12, p. 143). The son-in-law, Timothy Perry, and the son Ebenezer Ellis were appointed administrators. The widow's "thirds" were set off to the relict Jemima Ellis. Final distribu-tion was made to "Elijah Ellis the Eldest son of the deceased 1/6th part, a double portion" and to each of the other children "1/12th part, namely to Ebenezer Ellis, Elnathan Ellis, Abiel Ellis, Ephraim Ellis, Samuell Ellis, Reuben Ellis, Abigail Muxum and Eleanor Perry (land beginning southerly by Timothy Perry's land), Susannah Perry (land bounded by Timothy Perry), Anna Ellis," dated 2 Feb. 1762 (ibid., p. 275). The mother, Jemima Ellis, gave a receipt, dated 23 March 1763, for the shares of their father's estate due to the four youngest surviving children: Abiel, Ephraim, Samuel and Reuben Ellis (ibid., vol. 13, p. 135).
The will, dated 5 March and proved 10 May 1782, of "Jemima Ellis of Sandwich, ... widdow" gives "to my son Abiel Ellis [indoor moveables, he to be executor] ... to my son Reuben Ellis £4. to be paid out of the right I now have in the Estate both Real and Personal of my son Samuel Ellis, deceased ... to my sons Elnathan and Reuben, all my wearing apparel, except one gown I give to my son Ephraim's daughter." Witnessed by Moses Keene, Nathaniel Burgess, Zacheus Hatch (Barnstable County Probate, vol. 14, p. 101).
